All too often, pedestrians and bicyclists are hurt or even killed by operators of motor vehicles. Many times these accidents and injuries are the result of vehicle operators' negligence and failure to properly observe and be aware of those walking or riding a bike. Under the law, a bicycle is considered a vehicle, and with certain exceptions, riders of bicycles have the same rights and duties of those operating motor vehicles. Pedestrians, like cyclists, enjoy protection under the law. For example, the Texas Transportation Code requires a motor vehicle operator to yield the right of way to a pedestrian in a cross-walk if there is no traffic control device at the intersection and the pedestrian is either in the portion of the roadway where the vehicle is traveling or is approaching so closely as to be a danger.
